I guess it was only a matter of time. How many times can you have the best WR on your team get TE salary before they start forcing the issue. I'm not sure Hernadez has a legit argument, but Finley, Gronk and a few others certainly could use it as leverage. What it will certainly cause is for management to make sure they monitor a guys snap count at different positions, make sure he lines up tight for at least 51% of his plays.

Patriots tight end Aaron Hernandez won’t accept the franchise tag as a tight end next offseason. He’ll likely put up the argument that he’s more of a receiver then a tight end.
The franchise tag at the receiver position ($9.515 million) is almost double of what a tight end ($5.446 million) would receive this season.
